This is a large document, but has useful sections throughout if you want some good "bullets" or citations/sources.

From Annals of Allergy, Asthma, and Immunology

Food Allergy: a practice parameter

http://www.jcaai.readyportal.net/file_depot/0-10000000/20000-30000/27387/folder/63948/Food_Allergy_2006.pdf

Short on time? Look at their page 45 & 46, then will need to pull their list of citations/foot notes from the end as well.

At the good suggestion of ~E, I am linking to a few threads started will hopefully be helpful to those undergoing the 504 eligibility process. They deal with Major Life Activies affected by LTFAs.

Social / Emotional Condition as a Major Life Activity

Caring for one's self impairment regarding 504s

If threads for other Major Life Activities pop up, I'll be happy to link to them here.

Breathing as a Major Life Activity

This link is to a bit of a landmark moment for us in that OCR investigated an complaint based on ineligibility. Pete Wright has posted it on wrightslaw.com.

Currently you can scroll down to the fourth paragraph when you see Peanut Allergy.

http://www.wrightslaw.com/info/sec504.index.htm

The link to the Resolution Letter is here:
http://www.wrightslaw.com/law/504/OCR.va.peanut.pdf

And the thread that deals with it is here:
http://allergy.hyperboards.com/index.php?action=view_topic&topic_id=4795

I'm quoting Notnutty from that thread because of the summary:

McCobbre: This is a very good find indeed. Smiley I quickly looked through the decision and it appears that the OCR is strongly advising the school to qualify this student based upon the evidence presented.

They have not said that the student is eligible, but are requiring the school to look at the evidence, again...even though the evidence has not changed. What else is the school to do than to qualify? If they do not find the student eligible this time, the school has to provide the OCR documentation of the decision.

Thank you for posting!

The school basically ignored the doctor's evidence that the child has LTFA and didn't produce any counter evidence (like they could). OCR ruled that the SD denied FAPE. This is a very important ruling to us. And how wonderful that OCR went beyond its typical practice. Smiley

On FAAN's website, they have a Teacher's Checklist for Managing Food Allergies that says "Don't use food as an incentive or reward."
